These WiFi terms and conditions ("Terms") set out the agreement between you and AGS Airports Limited (“we”, “us”, “our”) under which we will permit you to use the wireless internet access service which is available in the Southampton Airport terminal building (“the Service”).

If you wish to access and use the Service you must first confirm that you have agreed to these Terms by ticking the appropriate acceptance box as part of the WiFi registration process and then clicking the appropriate button to get online. If you do not accept these Terms you cannot use our Service.

If you are under 18 years old, you must obtain your parent’s or guardian’s consent before using the Service. Where you are a parent or guardian consenting to the use of this Service by a person under 18, you agree to: (i) supervise their use; (ii) assume all associated risks; and (iii) assume any and all liabilities arising from their use of the Service.

Your attention is drawn specifically to the important service and security limitations and exclusions of liability contained in paragraphs 2, 3 and 7. Where you pay for the Service, you will not be entitled to cancel the Service once you've clicked on the appropriate button to get online. You also agree to reimburse us for any losses, liabilities, costs and expenses that we incur caused by misuse the Services or breach these Terms.

The Service is provided on the following Terms.

The Service

1.1 You will only be entitled to access and use the Services once you have accepted these Terms and we have received and accepted payment of any charge for the Service (where you have chosen a Service option which requires payment of a charge).

1.2 Your session starts at the time you click on the "Get Online" button. The session runs continuously from that point in time until the duration of the session has expired. Your session will automatically be terminated at the end of the period. At that time, you may select another available option to start a new session.

1.3 Where you have selected a service that involves the payment of a charge you acknowledge that by clicking the “Get Online” button you waive your statutory right (under the Consumer Contract Regulations 2013) to cancel the order prior to the supply of the Services.

1.4 The Service is only available when you are within range of the relevant WiFi hotspot network in the Southampton Airport terminal building.

1.5 To use the Service you must have a suitable WiFi enabled device with appropriate software which is compatible with the Service. The type, specification and condition of your device may affect your use of and access to the Service.

Service Limitations

2.1 The Service is provided over an unsecured, public WiFi network and is intended for recreational, non-business use. Whilst it is not a breach of these Terms to use the Service for business use (and you are permitted to do so if you wish) your attention is specifically drawn to the paragraphs in these Terms concerning Service Limitation, Security and Liability.

2.2 We use reasonable endeavours to provide the Service but we cannot guarantee or promise that the Service will always be available, or that the Service will be fault free or fit for any particular use or requirement.

2.3 We may impose usage or Service limits, or block certain kinds of usage, to protect, and to be fair to, other users. We cannot guarantee actual network speed because that varies on a number of factors, including the specification and configuration of your device and the general usage of the Service at the particular time.

2.4 We may temporarily suspend or restrict the Service because of an emergency or for operational maintenance or improvements. In such circumstances, the Service shall be restored as soon as reasonably practicable.

2.5 We are not responsible for data, messages, or pages that may stop working or for any information that may be lost because of interruptions or performance issues with our Service.

Security

3.1 We cannot guarantee that the Service is secure or that any information (including personal information) held on your device or shared using the Service will remain private.

3.2 Your use of the Service is at your own risk. When using the Service, particularly when transmitting or receiving any confidential or sensitive information or data, you should take appropriate steps to protect your data, for example using secure website connections, a virtual private network or personal firewall.

3.3 It is your responsibility to ensure that your device is adequately protected against viruses and other malware.

Acceptable Use

4.1 You are solely responsible for your use of the Service. We have no knowledge or control over the nature or content of information or data that you receive or transmit using the Service.

4.2 From time to time, we may restrict access to specific websites or categories of content without notice to you.

4.3 We are not responsible for any sites or content that you access whilst using our Service (other than our own) or anything you do while using the internet (including any items that you might download through our Service). We have no control over the content of other sites and we will not be liable to you if you use such sites.

4.4 You must not use the Service:

4.4.1 in a way that breaches these Terms;

4.4.2 in a way which breaches applicable laws, including laws on copyright and privacy;

4.4.3 to knowingly send, receive, upload, download, or use any material which:

4.4.3.1 is abusive, indecent, defamatory, obscene or menacing;

4.4.3.2 may contain viruses or any other malicious programs; or

4.4.3.3 overloads the Service

4.4.4 to access offensive or harmful sites, including those which contain adult, pornographic , hate, racist or other illegal or offensive material and those which may be used for illegal or harmful behaviour or purposes;

4.4.5 to send SPAM, or bulk email;

4.4.6 to send unsolicited advertising or promotional material;

4.4.7 in a way which attempts to modify, decompile or reconfigure the Service or software;

4.4.8 to carry out denial of service attacks or “, phishing, spying, hacking” , malware or other cyber-attack activities (including attempting to violate the security of any computer network)

4.4.9 to engage in any other activity which constitutes or is capable of constituting a criminal offence, either in the United Kingdom or in any other part of the world.

4.5 You will reimburse us for all reasonable losses, liabilities, costs (including legal costs) and expenses that we incur, either directly or if a third party make a claim against us, which arise from, a breach of these Terms, including any misuse of the Service, by you (or any person you have permitted to access the Service using your device).

4.6 We may terminate or temporarily suspend the Service if we reasonably believe that you are in breach of any of these Terms.

Your Privacy

5.1 We process personal information in accordance with the terms of our privacy statement and in accordance with any preferences you may have selected from time to time.

5.2 Our Service is provided on our behalf by a third party technology supplier and your personal information may be processed by that supplier as a processor on our behalf. We may also engage other suppliers to provide services to us that may involve the processing of your information for purposes within the scope of paragraph 5.1. All arrangements comply with data protection law.

Notifications to third parties

6.1 We keep a log of the Internet Protocol (“IP”) addresses of any devices which access the Service, the times when they have accessed the Service and the activity associated with that IP address.

6.2 We may provide assistance and information to law enforcement, governmental agencies and other authorities investigating any suspected or alleged unlawful activity and this may involve disclosing information such as that referred to in paragraph 19 to such agencies or authorities.

Liability

7.1 We limit our liability to you in a number of respects as set out in this paragraph 7.

7.2 We have no liability to you (and shall not have any responsibility to compensate you) for:

7.2.1 Business loss – this includes direct and indirect financial loss, loss of profit, revenue, time, anticipated savings or profit or revenue, opportunity, business, wasted expenditure, business interruption or loss arising from disclosure of confidential information;

7.2.2 Software/data loss - loss or corruption of software or data transmitted using the Service, or stored on your device or any service that you use;

7.2.3 Security - any viruses, malware attacks, deletion of files, data theft or alteration of your device or service that you use as a result of using the Service;

7.2.4 Third party sites/content - the content of any material of any third parties which you access using the Service; and

7.2.5 Circumstances beyond our control - failure to perform, or delay in performance of, the Service that is caused by events outside our reasonable control.

7.3 These exclusions of liability apply whether or not we were advised of the possibility of such loss or damage.

7.4 We do not in any way exclude or limit our liability for death or personal injury or fraud, and these Terms do not limit any rights you have under consumer protection laws.

Other matters

8.1 The contract created by acceptance of these Terms is personal to you so you cannot transfer it to someone else.

8.2 These Terms are governed and shall be interpreted in accordance with English law.
